Well another chapter has come together at the end of my fingers. I hope that every one enjoys it. FYI the CAG is very much like Frank Tripp so the line just fit him.
Year 4 Month 9 (One day after attack)
Aboard the USS Enterprise in the brig sat four people. Three youth and the mother of the Borden family, Ma Borden had not stopped ranting and raving about the big cat that had attacked her family. Because of her constant vocal abuse no one was left on brig duty more than one hour. One such change of guard as the private began to walk out the door he past too close to the brig itself and the oldest youth grabbed him and pulled him into the bars. He yelled at the newest guard, “Let us out of here!” The private that just came on duty backed away from the bars and hit the alert button. The loud whaling of the Claxton could be heard throughout the ship. He had his .45 caliber pistol drawn and aimed at Jr. “There ain’t no way we are going to let you out of that cell.” Into the brig four more Marines came at a run and all with weapons drawn. Behind them was the CAG (carrier air group commander) was right behind them. “Son, you are not getting out of here that way. And even if we let you out, where are you going. You are on a ship in the middle of a harbor? Now let my man go.” To this Jr. tightened his grip on the private larynx. “If you kill this boy, that just means that after the trail in New Hope we bring you back here for a military trail. That won’t be very easy on you.” The private was being deprived of air. The CAG stepped up to the bar and looked Jr. in the eyes his .45 pointed right between the boys’ eyes. “No, I think I will just save us the trouble of both trails and put this .45 slug in your brain now. 3. . .2. . .” Jr. let the private go. “Now see how easy we can negotiate when we try.” The CAG holstered his gun and turned to the men. “Put him in a cell by him self with strict instruction no one within 5 feet of his cell. And he is on bread and water rations.” He then turned back to Jr. “You just pissed off the wrong people here and in New Hope. You must be some kind of stupid.” He then turned and walked out. Back in New Hope the community was looking for someone to defend the Borden family. There were plenty who would sit in the other chair. Finely Capt. Harmon Rabb came forward and told Frank Tripp that he would defend the Borden family. Not only had he flown F-14 for the Navy but after he had lost his night vision he had went to law school and into JAG. When the war happened he had been on board the Enterprise overseeing a court marshal procedure. The Capt of the Enterprise at the time had lost his life a few months before the ship had found New Hope. Rabb was senior office on board so he was moved to the position of acting captain during a time of war. As he and Frank stood in the mayors office smoking a cigar and talking about who they could assign as council for the Borden family. Rabb pointed out that as a military lawyer he would not be harassed by the community for doing the best job of legal council. “It’s not going to get you an award with anyone here. But, I know that someone has to do it. You going to be the one to tell Horatio that you’re defending the sorry SOB that put a knife in Kate and left her to die?” Frank took a long draw of the cigar. “Yeah. I will tell him. I will also explain that I will give them the best legal defense that I can. Under the law they are entitled to that. But with all the evidence I will advise them to take a plea bargain and save the trail. It is in their best interest.” He took a draw on his cigar. He looked at the cigar for a moment. “I am glad that Cuba wasn’t damaged in the war. The best cigars come from there. I had to do some trading with them about six months ago. The man that I did the trading with gave me several cases of them as a good will gesture to continue business with them.” He took another puff from the cigar and laid it down in the astray on the mayor desk. “No time like the present to do a job that has to be done.” He turned and walked out of the office and got in the waiting jeep. As Rabb’s jeep pulled up in front of the Caine house he saw that there was a line of people that brought food or just wanted to know how Kate was doing. He walked up to the door and knocked. Natalia opened the door and looked at the captain. “I guess the Navy wants an update.” She opened the door wider to let him in; he removed his hat as he entered the house and laid it on the coffee table. “More like the Navy wants to update the mayor on the upcoming trail.” He nodded to Eric, Calleigh and Ryan. “Is he still in the room with her?” Lin Woo had come into the room and she looked at Rabb. “You smell of bad smoke. Don’t think I let you in room with my Kate and Horatio.” This brought a laugh from Calleigh. Everyone had to answer to Lin Woo and Alexx when it came to getting into the room with Horatio and me. Capt. Rabb looked at Lin Woo and bending down so that only she could here him; told her why he had come. She took a step back and looked up into his eyes. “You are good man. Horatio trust you to do what is right. Go talk to him he will understand.” She stepped out of Rabb’s way so that he could go down the short hall to the room where Horatio and I were. As he came in Horatio stood up from the chair that was close to the bed. He was still in the same suit that he had been in when Rabb had last seen him. He looked tired and older. They shook hands and Rabb explained that no one had come forward to defend the Borden family before he could admit that he had taken the job a smile crossed Horatio’s face. “You taking the job?” Rabb nodded. “They don’t deserve you. But I know that you will defend them the best you can. I will not hold it against you, nor will Kate.” As Rabb turned to leave he said over his shoulder. “You know that Mrs. Borden wants Lightning put down for killing her husband. I will have to present that at any trail.” He waited for Horatio’s answer to this information. “I have some proof that the big boy restrained himself just by looking at her wounds.” There was a pause. “Do you think they will take a plea bargain?” “That’s what I am going to try to get them to do. I will offer them one year aboard a ship under detention. Each will be on a different ship. It won’t be a luxury trip. They will be on brig arrest.” Rabb opened the door and left Horatio to think about what was discussed. When Capt Rabb got back to the Enterprise he was apprised of what had happened. He looked at the CAG for a brief moment. “Would you have shot the boy, CAG?” The CAG looked at his captain and said two words. “D- -m straight.” Rabb went to the brig and talked with the Borden family outlining why he thought their best defense was take a plea bargain. “Kate is going to live and a year of hard labor aboard a ship is a good deal. At the end of the year you will be released in separate cities. Basically you will not see each other again. As a unit you are a danger to communities. As we are trying to rebuild what we had and make it better at the same time this is a good offer.” The Bordens’ talked it over and took the deal. It was best all the way round for all that was involved.
